Terms of Service

This is an agreement between the organisation using the service (you) and Overspill, a trading name of an individual operating in the United Kingdom (we, us). Contact: privacy@overspill.dev.

1. This is a preview

Overspill is currently invite-only and free. No fee is charged. The consequences are worth stating plainly rather than burying: there is no uptime commitment, no support commitment, and no guarantee that a feature present today will still be there next month. Please do not build anything you cannot afford to lose on top of it.

2. Accounts and access

• Access is by invitation. An admin may invite members up to the organisation's seat limit.
• You are responsible for who you invite and for what they do with the account, including keeping your member list current when people leave.
• Sign-in links and ingest tokens are secrets. Treat them the way you would treat a password. Each machine gets its own token so that a lost or compromised one can be revoked without disturbing anybody else. Tell us if you believe one has leaked and we will revoke it.

3. Your data

• You own your data. Using the service does not change that.
• You grant us only the permission actually needed to store and process it in order to provide the service to you, and no more.
• We will not sell your data, share it with third parties, or use it to train machine-learning models.
• We do not receive your prompts, the model's responses, your code, or your shell commands. See the Privacy Policy for exactly what is and is not stored.
• You may ask for an export, or for deletion, at any time.

4. Acceptable use

You agree not to:

• use the service unlawfully, or to process data you have no right to send us;
• attempt to access another customer's data, or any part of the service not meant for you;
• attack, overload, or probe the service. Genuine security research is welcome — please report what you find to privacy@overspill.dev rather than demonstrating it on other customers;
• resell the hosted service, or offer it to third parties as your own.

5. Availability and changes

During the preview the service may be suspended, changed, or discontinued. If we decide to shut it down or delete data, we will give account admins reasonable notice first and time to export — except where we have to act immediately for security or legal reasons.

6. Suspension and termination

We may suspend or close an account that breaches these terms, or whose usage threatens the stability of the service for others. Where it is practical to warn you first, we will. You may stop using the service and ask for your data to be deleted at any time, for any reason or none.

7. No warranty

The service is provided as is. To the fullest extent permitted by law we make no warranties of any kind, express or implied, including that it will be uninterrupted, error-free, or that the figures it produces are accurate. Cost estimates depend on published model prices and on correctly interpreting each tool's records; treat them as a well-founded estimate, not an invoice. Nothing here affects rights that cannot be excluded by law.

8. Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost business, or loss of data. Where liability cannot be excluded, it is limited in aggregate to the greater of the fees you paid us in the preceding twelve months — currently nil, during the free preview — or one hundred pounds.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

9. Changes to these terms

We may update these terms as the service develops. Material changes will be sent to account admins rather than quietly published, and continued use after that constitutes acceptance.

10. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
